Music Licensing Terms and Conditions
By purchasing music Licenses sold or advertised by BooKooBeats.com, BooKoo Beats or BooKoo Music (ASCAP), you automatically become bound to the terms of the BooKoo Music Licensing Agreement. Full Licensing Details and Agreements will be included with the purchase of a music license.
BooKoo Beats (also “BKB”) offers four types of music licenses to our clients for purchase: (i) the LEASING LICENSE, (ii) the EXCLUSIVE LICENSE, (iii) the CUSTOM LICENSE and (iv) the PROMO LICENSE.
(i) LEASING LICENSE: The BKB LEASING LICENSE grants you the right to use BKB musical composition(s) (referred to as “BEATS”) for One (1) Commercial Use with distribution of 2000 units or less. Authorized Uses covered by this license are Albums, Mixtapes, Showcases, Live Performances, Artist Demos or Internet Background Music. If a project using one of our BEATS sells, downloads or distributes 2000 or more units or you plan to use one of our BEATS one more than One (1) project, BooKoo Beats requires that you to purchase an EXCLUSIVE LICENSE or CUSTOM LICENSE.
The Leasing License DOES NOT PERMIT the use of a BEAT on Music Video, Film, TV, Online Video or Advertising projects. You must purchase an EXCLUSIVE LICENSE or CUSTOM LICENSE to be eligible for Film/TV/Video Synchronization Licensing and Rights.
Under the LEASING license, all musical compositions and beats remain the sole property of BooKoo Beats. BKB musical compositions may not be resold and BKB music licenses are non-transferable. None of the BKB compositions offered through the LEASING licensing agreement are sold to you (the licensee), but rather are licensed for the above specified non-exclusive use. BKB reserves the right to sell or solicit additional licenses for identical musical compositions to other clients through the use of the LEASING LICENSE. All distributed works containing BKB musical compositions must show the following legal music and liner note credit/Mp3 Tag: “Fresh Produce provided by BooKoo Beats.”
(ii) EXCLUSIVE LICENSE: The BKB EXCLUSIVE LICENSE grants you the right to use BKB’s BEATS for Unlimited Commercial Uses with No distribution limits. Authorized Uses covered by this license are Indie or Major Albums, Mixtapes, Showcases, Digital Downloads, Digital Streams, Live Performances, Music Video, Online Video, Film & TV Projects and Advertising Projects. If your project using one of our BEATS sells, downloads, streams or distributes 2000 or more units or you plan to use one of our BEATS one more than One (1) project, BooKoo Beats requires you to purchase an EXCLUSIVE LICENSE or CUSTOM LICENSE .
The Exclusive License PERMITS the use of a BEAT on Music Video, Film, TV, Online Video or Advertising projects. Upon purchase, you will be sent an additional form for Film/TV/Video Synchronization Licensing and Rights.
EXCLUSIVE licenses are only sold to ONE CLIENT/END USER and the exclusive rights to use the BEATS cannot resold or transferred to any other party. BKB EXCLUSIVE LICENSING agreements include provisions for:
- Copyright: Client owns the copyright for their created lyrical/written portion and the resulting Sound Recording. BooKoo Beats retains copyright of the original musical composition.
- No Sales Royalties: Through the EXCLUSIVE License, Production and Sales royalties are NOT due to BooKoo Beats based on album, single or digital download sales. BooKoo Beats and BooKoo Music (ASCAP) maintain their co-publishing rights and mechanical rights as composer and co-publisher, respectively, of the licensed musical composition(s).
- Production Credit: All distributed works containing BKB musical compositions must show the following legal music and liner note credit/Mp3 Tag: “Fresh Produce provided by BooKoo Beats.”
(iv) CUSTOM LICENSE: CUSTOM LICENSES are only offered with beats produced via BKB’s custom music production services. BKB’s custom production services are commissioned at a higher rate to construct a custom musical composition to fit your specific client preferences. (iii) PROMO LICENSE: BKB PROMO Licenses are offered when “FREE” Downloads and “PROMO” Beats are available for download or email link via BooKooBeats.com or the BooKoo Beats Sounclick or MySpace page. The BKB PROMO License grants you (the licensee), the right to use BEATS for Artist Demonstration purposes, MySpace and Social Profile promotions and other non-commercial Online Promotional purposes only. PROMO License holders are strictly prohibited from using BKB’s BEATS on projects with commercial sales pontential such as Albums, Mixtapes, Showcases, Live Performances, Radio Singles & Radio Rotation, Digital Singles or Paid Streams, Television Shows, Television Broadcast, and/or Film/DVD Soundtracks. If your intended use of BKB musical compositions has a commercially viable means of generating revenue, and/or is NOT promotional or non-profit, you are required by law to obtain a LEASE LICENSE, EXCLUSIVE LICENSE or CUSTOM LICENSE from BooKoo Beats / BooKoo Music (ASCAP).
In regards to PROMO LICENSES and “FREE DOWNLOADS”, it is also understood that there are NO FREE BEATS. All “FREE DOWNLOADS” are meant for demonstration and listening purposes only. All musical compositions and beats remain the sole property of BooKoo Beats and are licensed for NON-COMMERCIAL USE ONLY. BKB musical compositions may not be resold and BKB music licenses are non-transferable. None of the BKB compositions offered through the PROMO licensing agreement are sold to you (the licensee), but rather are licensed for the above specified promotional, non-exclusive use. BKB reserves the right to sell or solicit additional licenses for identical musical compositions to other clients through the use of the LEASE LICENSE, EXCLUSIVE LICENSE or CUSTOM LICENSE. All distributed works containing BKB musical compositions must show the following legal music and liner note credit/Mp3 Tag: “Fresh Produce provided by BooKoo Beats.” All “FREE DOWNLOADS” and BEATS that are subject to the “PROMO LICENSE” will remain tagged with the BKB Vocal Credit/Tag.
As an Artist, Label, Manager or Media company….. a BKB Music License gives you the authorized permission to use our BEATS on your promotional or commercial music and video projects. It is specifically understood and agreed that Licensee does not acquire any rights to the underlying musical compositions which are licensed through BKB’s Music Licenses. BooKoo Music (ASCAP) retains all rights, title and interest in the musical composition obtained from BooKoo Beats, including all copyrights belonging to the original copyright holder.
Artists, labels, film or media companies that are interested RETAINING ALL INCLUSIVE RIGHTS to any BKB musical compositions can Contact BKB at

If you intend to use ANY of BKB’s BEATS, you must legally obtain a BKB music license. If your intended use of BKB musical compositions has a commercially viable means of generating revenue, and/or is NOT demonstrational or promotional, you are required by law to obtain a LEASE LICENSE, EXCLUSIVE LICENSE or CUSTOM LICENSE from BooKoo Beats / BooKoo Music (ASCAP). Failing to obtain the proper legal license from BooKoo Beats will only result in copyright infringement fines and possible confinement. A single violation of federal copyright laws will cost you a $30,000.00 fine.
All BKB Music Licenses expressly FORBID resale or other distribution of BooKoo Beats musical compositions, either as the exist OR any modification thereof. You (the Licensee ) are not authorized to sell, loan, rent, lease, assign, or transfer all OR any portion of the beats or products sold through BooKoo Beats, BooKoo Music (ASCAP) or BooKooBeats.com to another user, or for use in any competitive product or website.
